- Question 3: Do you support the establishment of โRed Flag lawsโ that would allow judges to issue Extreme Risk Protection Orders to remove firearms from individuals deemed dangerous? For those in favor, select โFor the Amendment,โ and if you disagree, check โAgainst the Amendment.โ

While the city council is eager for these changes, state leaders have voiced strong opposition. Important figures such as Lt. Governor Randy McNally, House Speaker Cameron Sexton, and Attorney General Jonathan Skrmetti have stated that even if voters approve the referendum, the gun restrictions could be nullified due to conflicts with existing state law. Furthermore, state GOP leaders have threatened to withhold vital funding for the City of Memphis if the referendum was included on the ballot.
Despite these challenges, the city council did not back down. They fought a legal battle and won, allowing the referendum to proceed to voters. Councilman Warren views this as just the beginning of a much larger effort to implement common-sense gun control in Memphis.
