Lawmakers Split Over Jail Cost of Tennessee Bail Amendment

NASHVILLE, Tenn. — The fight over Constitutional Amendment 1 is shifting from the crimes listed on the ballot to the bill counties could face if more defendants sit in jail before trial.

The amendment would let courts refuse bail when someone is charged with a capital crime, a terrorism count, second-degree murder, the gravest rape offenses involving children or adults, grave torture, or any offense that already carries an 85 percent sentence rule. Judges would have to put their bail decision for those cases into the written record.

Lawmakers who placed the measure on the ballot attached a published fiscal note of roughly $9,400 — mainly the cost to print the amendment text. Rep. Vincent Dixie, a Nashville Democrat, says that number ignores the long-term tab. He argues local jails would pick up housing, meals and medical care, funded through county property and sales taxes.

Dixie also flags the seventh category, the 85 percent offenses, as the undefined stretch of the list. Tennessee already applies that sentencing rule to a long roster that includes aggravated assault, kidnapping enhancements, robbery with aggravating facts, carjacking and arson with aggravating facts. When the Truth in Sentencing package moved in 2022, its fiscal note warned yearly incarceration costs could climb toward $40 million, and Gov. Bill Lee sent the bill back unsigned, saying similar policies had packed prisons without lowering crime.

Dixie says more than 20 county lockups are already past capacity. Rutherford County, he notes, runs a jail built for about 550 people that has held roughly 1,050 on ordinary days and spiked toward 1,200.

Supporters answer with victims. House Speaker Cameron Sexton has said the real cost shows up when someone freed on bail later kills people, and Rep. Dan Howell of Cleveland has argued lives might have been saved if the amendment were already law. Voters settle the question Nov. 3 under the dual threshold that applies to every constitutional change: yes must beat no, and yes must also clear half of all votes cast for governor.
